The Federal Hazardous Materials Transportation Act (HMTA), 49 U.S.C. 5101 et seq., preempts California's reusability mandate for propane cylinders in California Public Resources Code, Sections 42395- 42395.2. The reusability mandate imposes localized design and manufacturing requirements on a container that is represented, marked, certified, or sold as qualified for use in the transportation of a hazardous material--specifically, propane--that are not substantively the same as the requirements in the HMR. The reusability mandate is also an obstacle to accomplishing and carrying out the HMTA. By banning a federally authorized, safety-compliant packaging based on localized waste management preferences, California creates a fragmented regulatory patchwork that undermines the primacy and uniformity of the Federal transportation safety framework.
Hazardous Materials: Notice of Administrative Determination of Preemption for Common Law Tort Claims Concerning the Transportation of Gasoline
The Exxon Mobil Corporation (Exxon) seeks a determination that Federal law preempts State common law claims brought against it in New Jersey concerning the safe transportation of gasoline in commerce. PHMSA is issuing a final administrative determination concluding that the State common law tort claims presented by Exxon are preempted. Each of these duties, if imposed, would present an obstacle to compliance with the Federal regulatory framework essential for the safe transportation of gasoline. In addition, any claims about covered subjects, such as the marking, loading and unloading, and classification of gasoline that are not substantively the same as the applicable HMR provisions are preempted.
Gexcon U.S., Inc.'s Petition for EFFECTS Version 12.2.0 as an Alternative Model for Calculating the Vapor-Gas Dispersion Exclusion Zone
PHMSA is publishing this notice and a draft letter of decision to solicit public comment on a petition for approval that would authorize the use of an alternate flammable vapor-gas dispersion model in connection with the siting of liquefied natural gas (LNG) facilities.
Pipeline Safety: Joint Meeting of the Gas and Liquid Pipeline Advisory Committees
On July 17, 2026, PHMSA published a Federal Register notice titled: "Pipeline Safety: Joint Meeting of the Gas and Liquid Pipeline Advisory Committees," which provided an opportunity for public comment by August 31, 2026, on the proceedings of the Gas and Liquid Pipeline Advisory Committees meeting related to 13 notices of proposed rulemakings (NPRM). These proposed rules covered topics such as special permit conditions, in-plant piping, incidental gathering lines, coating damage assessments, atmospheric corrosion, class change pressure tests, maximum allowable operating pressure reconfirmation, operator identification notifications, limitations on welding, remote valves, the property damage definition, right-of-way patrols, and reporting deadlines. PHMSA received requests from stakeholders to extend the comment period. Based on those requests, PHMSA is reopening the comment period for the joint Pipeline Advisory Committee (PAC) proceedings related to the 13 regulatory modernizing NPRMs to September 4, 2026.

Hazardous Materials: Reducing Burdens on Domestic Companies Using Battery-Powered Equipment in Trades
This final rule modernizes the Materials of Trade (MOT) exception in the Hazardous Materials Regulations (HMR) by increasing the maximum allowable quantities of lithium batteries that can be transported as MOTs. This increase removes an undue regulatory burden which constrains the ability of construction, landscaping, mowing, tree service, food service, and entertainment companies to perform their trade.

Pipeline Safety: Guidance for Enhancing the Effectiveness of Distribution Integrity Management Programs
PHMSA issues this advisory bulletin to remind owners and operators of gas distribution systems of the distribution integrity management program (DIMP) requirements under 49 CFR part 192, subpart P. The guidance is intended to improve implementation of DIMP risk evaluations by addressing factors such as high-risk infrastructure, interactive threats, and leak management effectiveness. In addition, the guidance urges pipeline operators to adopt the most appropriate risk models for use within their integrity management programs, with full consideration of probabilistic risk models.
Pipeline Safety: Repair Criteria for Hazardous Liquid and Gas Transmission Pipelines
PHMSA proposes to modernize and to clarify the anomaly response criteria in the Federal pipeline safety regulations for gas transmission and hazardous liquid pipelines. Driven by twenty years of technological development, modern engineering concepts allow operators to identify, schedule, and remediate pipeline anomalies more effectively and in a less costly manner. PHMSA proposes incorporating these improved safety practices into its regulations by finalizing certain safety improvements advanced in recent rulemakings for gas transmission pipelines and extending those changes to hazardous liquid pipelines. In addition, PHMSA proposes certain non-substantive revisions to its gas and hazardous liquid repair regulations to improve compliance.
Hazardous Materials: Information Collection Activities
In accordance with the Paperwork Reduction Act of 1995, this notice announces that the Information Collection Requests (ICRs) discussed below will be forwarded to the Office of Management and Budget (OMB) for renewal and extension. These ICRs describe the nature of the information collections and their expected burdens. A Federal Register notice and request for comments with a 60-day comment period on these ICRs was published in the Federal Register on January 30, 2026 (91 FR 4172) under Docket No. PHMSA-2026-0199 (Notice No. 2026-04). PHMSA received one comment in response to the 60-day notice from the Railway Safety Institute (RSI) regarding OMB Control Number 2137-0559, "Rail Carrier and Tank Car Tanks Requirements, Rail Tank Car Tanks-- Transportation of Hazardous Materials by Rail" (expiring September 30, 2027). However, PHMSA is not addressing the renewal of this OMB Control Number in today's notice.
