Under the 2023 Environmental Code, any project that is likely to have an environmental impact - including any oil or gas project - is subject to a prior environmental assessment (Article 68). Environmental assessments must take into account the national adaptation and mitigation strategies adopted by the Government of Côte d'Ivoire.
The Environmental Code also authorizes the Government of Côte d'Ivoire to adopt regulatory standards on the release and emission of air pollutants (Article 125). Furthermore, the government is required to implement air pollution control standards (Article 60), and oil and gas installations are required to comply with these standards (Article 62).
The Environmental Code also requires the Government of Côte d'Ivoire to develop a national inventory of anthropogenic greenhouse gas (GHG) emissions, which must be developed according to the methodologies established under the United Nations Framework Convention on Climate Change and under the Paris Agreement (Article 87).
The Environmental Code also establishes an “Environment and Sustainable Development Fund” (Article 65). This fund is intended to mobilize or receive resources for projects and programs related to the protection and sustainable management of the environment. It includes a dedicated window for climate change initiatives.
