Article 11 of Legislative Decree 135/2018 modifies the rules governing concessions for large hydroelectric diversions, providing for the regionalization of ownership of hydroelectric works upon expiry of the concessions and in cases of forfeiture or renunciation of the same, and in particular, the transfer to the regions, once the concession has ceased, of the so-called "wet works" (dams, pipelines, etc.) free of charge and of the so-called "dry works" (tangible assets), with payment of a price to be quantified net of depreciated assets, according to given criteria. The procedures for assigning concessions for large hydroelectric diversions must be started within two years of the entry into force of the regional law that establishes the methods and procedures for assignment, according to legislatively predefined criteria illustrated above, and in any case no later than 31 December 2023. This maximum term was inserted by the Competition Law 2021.
