The Environmental Permitting Regulations 2016 consolidate pre-existing regulations involved in environmental permitting, including regimes covering waste management licensing, pollution prevention and control, landfill, waste incarceration, the operation of large combustion plants, water discharge consents, groundwater authorisations, radioactive substances and mining waste and batteries.

Schedule 20 on Mining waste operations applies to every mining waste operation and outlines the authority and missions of the regulator in the review of environmental permits, classification of mining waste facilities, inspections and closure of mining waste facilities.
