The Energy Efficiency Act was established by Law nº 10,295/2001, and defined that the establishment, by the Executive Power, of minimum energy performance standards (MEPS) for energy-consuming machines and equipment. According to the specific regulations defined to each class of equipment, units not complying the regulations cannot be manufactured, imported or commercialized in the country after determined dates, considering adaption periods for manufacturers and traders.

Since its launch, ten different equipment classes were regulated according its energy efficiency, as it can be seen below:

Most recently, the Interministerial Committee that elaborates and establishes the regulations was reformulated through Decree nº 9,864/2019. For 2021 it is expected to have revised MEPS for air conditioners and refrigerators, as well as a study on new MEPS regulation for portable air conditioners and commercial refrigerators.
