The Communication from the Commission – Guidelines on State aid for climate, environmental protection and energy 2022 are part of the broader EU regulatory framework under Article 107(3)(c) of the Treaty on the Functioning of the European Union. This article permits state aid that supports the development of specific economic activities or regions, provided it does not significantly distort competition within the EU. The guidelines ensure that state aid measures align with EU policies, particularly the European Green Deal, which aims for a climate-neutral Europe by 2050. They establish the criteria the European Commission uses to assess the compatibility of state aid measures with the internal market. Member States must notify the Commission of their state aid plans, which are then evaluated based on these guidelines. While not legally binding, the guidelines are crucial for ensuring compliance with EU state aid rules.

The guidelines include several provisions that support recycling and the transition towards a circular economy:

Resource Efficiency: Aid can be granted for projects that improve resource efficiency, including recycling and waste management initiatives.

Circular Economy: Support is available for activities that promote the circular economy, such as the reuse, repair, and recycling of materials.

Pollution Prevention: Aid measures can also target the prevention or reduction of pollution, which includes initiatives aimed at reducing waste and promoting recycling.
