Announcement 46 from the Ministry of Commerce (MOFCOM) focuses on enhancing export controls on specific dual-use items to the United States to protect national security and adhere to international non-proliferation commitments. The announcement strictly prohibits the export of dual-use items to U.S. military users or for military purposes. It imposes stringent licencing restrictions on items such as gallium, germanium, antimony and superhard materials, generally denying export licences for these items to the U.S. Additionally, graphite exports to the U.S. will undergo more rigorous end-user and end-use reviews. Organisations and individuals who violate these regulations by transferring or providing relevant dual-use items originating from China to U.S. entities will face legal consequences. This announcement took effect immediately upon its publication on December 3, 2024.
