The Mining Act of 1978 consolidates law relating to mining in Western Australia. The Act is subject to the Environmental Protection Act 1986, and in the case of inconsistencies in provisions between the Acts, the relevant Mining Act provision will be deemed inoperative.
Part I, Section 9 of the Act declares gold, silver and other precious metals as property of the Crown.
Part III of the Act delineates land open for mining concerning property of the Crown, public reserves and commonwealth, and private property.
Part IV of the Act establishes criteria and procedures for the permitting of prospecting, exploration and retention licenses, as well as mining, general purpose and miscellaneous leases.
