Regulations — Governor in Council approval

Section 354 of the Canadian Energy Regulator Act authorizes the Regulator to establish regulations (subject to Governor in Council approval) governing exemptions from reporting requirements, licence application procedures and information requirements, and standards for measurement units and instruments used in oil and gas export and import activities.

Regulations — Governor in Council approval

354 (1) Subject to the approval of the Governor in Council, the Regulator may make regulations (a) exempting persons or classes of persons from the application of section 352; and (b) prescribing anything that is to be prescribed under that section. (2) The Regulator may make regulations (a) respecting the information to be provided by applicants for licences and the procedure to be followed in applying for licences and in issuing licences; and (b) prescribing units of measurement and measuring instruments or devices to be used in connection with the exportation or importation of oil or gas.

Reimbursement — measures taken by government institution

The Canadian Energy Regulator Commission may order pipeline operators to reimburse federal, provincial, municipal governments, Indigenous bodies, and other persons for reasonable costs incurred responding to unintended or uncontrolled releases of oil, gas, or other commodities from pipelines, even if costs exceed the operator's statutory liability limits.

Jurisdiction

The Canadian Energy Regulator has exclusive jurisdiction to investigate non-compliance with the Act and authorization conditions, inquire into accidents involving pipelines, abandoned pipelines, international power lines, and offshore renewable energy projects, and issue findings, recommendations, and orders in the public interest.
